Everkind Companions Limited (“we”, “us”, “our”) is a New Zealand registered company (NZBN: 9429053359940) providing online phone companionship services. Our website is located at ever-kind-companions.com.

2. Acceptance of Terms

By booking a session or using our services, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use our services.

3. Our Services

Everkind Companions provides one-on-one phone companionship sessions. Our service is a companionship service only. We are not:

  • A mental health service or counselling service
  • A medical service
  • A crisis intervention service
  • A friendship or dating service

If you are experiencing a mental health crisis, please contact a qualified professional or call or text 1737 (New Zealand’s mental health helpline, available 24/7).

4. Eligibility

You must be 18 years of age or older to use our services. By booking a session, you confirm that you are at least 18 years old.

5. Bookings

Sessions are booked via our online booking form. A booking is confirmed only when we send you a written confirmation by email. We reserve the right to decline any booking at our discretion.

6. Pricing and Payment

All prices are in New Zealand Dollars (NZD) and are inclusive of GST where applicable.

  • Appointment — 30 minutes: $45 NZD
  • Appointment — 60 minutes: $80 NZD
  • Casual Rate: $2.00 NZD per minute (minimum 15 minutes)

Payment is due after your session is completed. We accept credit card and bank transfer. New Zealand customers may pay by bank transfer. International customers are required to pay by credit card via Stripe.

7. Cancellations and Rescheduling

We understand that plans can change. Please notify us as soon as possible if you need to cancel or reschedule.

  • Cancellations made more than 24 hours before the session: no charge.
  • Cancellations made less than 24 hours before the session: a cancellation fee of 50% of the session rate may apply.
  • No-shows (no contact and no cancellation): the full session rate applies.

8. Conduct

We expect all clients to treat our companions with respect. We reserve the right to end a session immediately, without refund, if a client engages in:

  • Abusive, threatening, or harassing behaviour
  • Sexual or inappropriate language or requests
  • Any behaviour that makes our companion feel unsafe

Clients who engage in such behaviour may be permanently banned from our services.

9. Limitation of Liability

To the maximum extent permitted by New Zealand law, Everkind Companions Limited is not liable for any indirect, incidental, or consequential loss or damage arising from your use of our services. Our total liability to you in any circumstances is limited to the amount paid for the session in question.

Nothing in these Terms limits your rights under the New Zealand Consumer Guarantees Act 1993 or the Fair Trading Act 1986.

10. Intellectual Property

All content on our website, including text, images, and logos, is the property of Everkind Companions Limited and may not be reproduced without our written permission.

11. Changes to These Terms

We may update these Terms from time to time. Any changes will be posted on this page with an updated date. Continued use of our services after changes are posted constitutes your acceptance of the new Terms.

12. Governing Law

These Terms are governed by the laws of New Zealand. Any disputes will be subject to the exclusive jurisdiction of the New Zealand courts.

We will not use your information for marketing purposes without your consent.

  • Stripe: for secure payment processing

Refund Policy

We want you to feel comfortable booking with us. Here is our refund policy, in plain language.

Appointment Sessions

  • If you cancel more than 24 hours before your session: no charge.
  • If you cancel less than 24 hours before your session: a cancellation fee of 50% of the session rate may apply.
  • If we cancel your session for any reason: you will not be charged.

Casual Rate Sessions

Casual rate sessions are billed after the session is completed, based on the actual time spent. You will only be charged for the time used, subject to the minimum 15-minute charge.

Disputes

If you believe you have been charged incorrectly, please contact us within 7 days of your session at everkindcompanions@gmail.com and we will review your case promptly.

Consumer Guarantees Act 1993

Nothing in this Refund Policy limits your rights under the New Zealand Consumer Guarantees Act 1993.
